The city of Vandalia has told a couple to stop its plans to operate a restaurant on Vandalia Lake.
It has also decided to seek a court ruling on the issue.
After meeting is closed session for a little more than 30 minutes on Monday, Mayor Rick Gottman asked Don Sheafor of the city’s legal counsel to explain that the city has asked the firm to ask for a declaratory judgment against Steve “Luke” and Latisha Mabry.
The Mabrys are planning to operate a steakhouse on Vandalia Lake at the bridge on Ill. Route 185.
The city claims, as contended by people living in that area, that the Mabrys cannot do so, because their property is zoned residential as a result of an agreement with the former owner of the land.
Gottman had Sheafor explain that the city, after its June 3 meeting, had the legal counsel send a "cease and desist" letter to the Mabrys.
